There are ONLY three (3) ways to plan your Estate:
1. Do nothing. The State of Illinois has a Last Will and Testament for you. You may not like the beneficiaries of this Will.
2. Sign a Last Will and Testament. This is a written document which tells the Court how to divide your assets upon your death. Your Last Will and Testament can also tell the Court who should be the Guardian of your minor children.
Your Last Will and Testament is ONLY filed with the Court upon your death, and the Court oversees the administration of your Probate Estate. Your Probate Estate will most likely need to have an attorney to guide the Estate through the probate process. Your Will is basically your last wish and promise to be carried out after your death.
